Partner Visa Australia (Spouse Visa) Overview
If you are in a genuine and ongoing relationship with an overseas partner, you may be eligible to sponsor them for a Partner Visa in Australia. As an Australian citizen, permanent resident, or eligible New Zealand citizen, you can help your loved one enter or remain in the country under this visa program.
Types of Partner Visas
Partner Visa (Subclass 820 & 801)
This is for a spouse or de facto partner, including a same-sex partner of an Australian sponsor. Start with the Subclass 820 Partner Visa (temporary). Once approved, you can then apply for the Subclass 801 Partner Visa (permanent). The applicant must be in Australia to apply for this Visa.
Partner Visa (Subclass 309 & 100)
If you have sufficient evidence to prove your relationship, you can apply for the Subclass 309 Partner Visa (temporary). After it is granted, you can travel to Australia and then apply for the Subclass 100 Partner Visa (permanent).
Prospective Marriage Visa (Subclass 300)
Designed for fiancés overseas who intend to marry their Australian sponsor. Once granted, the visa holder has up to nine months to marry, either in Australia or overseas. Once granted, Marry your fiancé within the prescribed time then apply for Onshore Partner Visa (Subclass 820 & 801).
Who Can Be a Sponsor?
To be a sponsor, you must meet the following criteria:
Be an Australian permanent resident, citizen, or eligible New Zealand citizen.
You can sponsor a maximum of two spouses or de facto partners in your lifetime and only one within a five-year period, unless exceptional circumstances arise.
